2. Intellectual property rights application

Intellectual property created through employee inventions at our university is Article 10, Paragraph 2 of the Invention Promotion Act, Article 27, Paragraph 3 of the Act on the Industrial Education Enhancement And Industry-academia-research Cooperation Promotion Act., and Article 6 of the State University of New York Korea Intellectual Property Rights Management Regulations.

In accordance with intellectual property rights management regulations, inventors affiliated with the State University of New York Korea must report employee inventions resulting from research to Research Support Team, and the subsequent patent application procedures must be conducted through Research Support Team

3. Intellectual property registration and cost support

National and international application fees for intellectual property rights are provided after assessment. This applies specifically when the applicant is a sole R&BD F group, with a full-time faculty member included as the responsible inventor

Support provisional application (claims deferral submission/provisional specification submission) costs

  • If the disclosure of the contents of the invention is imminent (paper publication, conference presentation, etc.) or if the representative inventor's patent support overhead is insufficient, the application can be filed quickly as a preliminary application (deferred claim submission/provisional specification submission), and thereafter, a regular application can be filed. Proceed with priority claim application.
  • A formal application must be filed within one year after filing a provisional specification application, and the cost of filing a provisional specification application is not supported by the university (not preserved after invention evaluation).

Proceed with the patent application process as soon as possible after publication of the paper.

  • Patent applications can be filed in Korea, the United States, and Japan within one year from the publication date (date of journal publication, seminar presentation date) (not possible in China and Europe). When reporting an invention, clearly state the disclosure date.

4. Maintenance of intellectual property

Intellectual property rights maintenance period (Article 7 of the SUNY Intellectual Property Protection Guidelines)

  • After patent registration, maintenance costs are borne by Research Support Team for 5 years. Rights can be waived after 6 years of registration.
  • Notification of intention to give up will be given to the representative inventor within 3 months from the 5th year annual fee payment date.
  • Intellectual property rights recognized as necessary by Research Support Team can be maintained.
  • If the maintenance cost is borne by the inventor, it can be maintained in the name of Research Support Team (additional compensation is paid to the inventor).
